These Terms of Use ("Terms") govern your access to and use of the Dealjacket marketing website at dealjacket.com (the "Site"). "Dealjacket" means Dealjacket, LLC. Use of the Dealjacket product itself is governed by a separate Master Services Agreement between Dealjacket and the dealership.

By accessing the Site, you agree to these Terms. If you do not agree, do not use the Site.

The Site is intended for business and informational use. You may use the Site only if you are at least 18 years old and able to form a binding contract under applicable law.

Some parts of the Services require an account. You are responsible for the accuracy of the information you provide and for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account.

When using the Site, you agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms.
• Attempt to gain unauthorized access to any part of the Site or any related systems.
• Probe, scan, or test the vulnerability of the Site or breach any security measures.
• Use any automated means (scrapers, bots) to access the Site without our written permission.
• Reverse engineer, decompile, or attempt to derive the source code of any part of the Services.
• Use the Site to transmit malware, spam, or harassing content.

Use of the Site is free. Use of the Dealjacket product is governed by the pricing and payment terms in your Master Services Agreement.

You retain ownership of any content you submit through the Site (for example, a demo request message). You grant us a worldwide, non-exclusive, royalty-free license to use that content solely to operate and provide the Services and to respond to your inquiry.

The Site, the Dealjacket product, and all content, features, and functionality are owned by Dealjacket, LLC or its licensors and are protected by U.S. and international copyright, trademark, and other intellectual property laws.

"Dealjacket" and the Dealjacket logo are trademarks of Dealjacket, LLC. You may not use them without our prior written permission.

We may suspend or terminate your access to the Site at any time for any reason, including violation of these Terms. Sections that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will survive.

The Site is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Screens and product imagery shown on the Site are representative of features and may differ from the live product.

To the maximum extent permitted by law, Dealjacket, LLC and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Site.

Some jurisdictions do not allow these limitations, so they may not apply to you.

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws principles. Any dispute arising out of these Terms will be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
